Please read these Terms of Service carefully before using IbomMarket. By accessing or using our platform, you agree to be bound by these terms. If you do not agree, you must not access or use the platform.

1. Introduction

Welcome to IbomMarket ("Platform", "Service", "we", "us", "our"), a product of Ibom Market Global Limited, a company incorporated under the laws of the Federal Republic of Nigeria with its registered office in Uyo, Akwa Ibom State. These Terms of Service ("Terms") govern your access to and use of our website, mobile applications (including Progressive Web App and native Android/iOS applications), and all related services and features.

IbomMarket is a multi-vertical marketplace platform that enables users to buy, sell, and discover products and services across multiple categories, including but not limited to general goods, vehicles, real estate, electronics, fashion, hospitality (hotels and short-let accommodation), food and restaurants, professional services, and classifieds.

By creating an account, accessing, or using IbomMarket, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Cookie Policy, our Community Guidelines, and all other policies referenced herein.

2. Definitions

  • "User" refers to any individual or entity that accesses or uses IbomMarket, including Buyers, Sellers, Hosts, Restaurant Operators, Service Providers, Marketers, and visitors
  • "Seller" refers to Users who list products or services for sale on the Platform
  • "Buyer" refers to Users who purchase, order, book, or inquire about products or services
  • "Host" refers to Sellers who list accommodation or hospitality properties (hotels, short-lets, guest houses) for booking
  • "Restaurant Operator" refers to Sellers who operate restaurants or food service businesses on the Platform
  • "Service Provider" refers to Users who offer professional services (mechanics, artisans, technicians, etc.) through the Platform
  • "Marketer" or "Affiliate" refers to Users participating in the IbomMarket affiliate/referral program
  • "Content" refers to any text, images, videos, audio, reviews, or other materials posted on the Platform
  • "Listing" refers to advertisements, product postings, service offerings, accommodation listings, restaurant menus, or urgent request postings created by Users
  • "Store" refers to a Seller's dedicated storefront on the Platform, including general stores, hotel properties, and restaurant profiles
  • "Booking" refers to a reservation or appointment made through the Platform for accommodation, services, or food orders
  • "Order" refers to a confirmed purchase of goods, food, or services processed through the Platform
  • "Market Coins" refers to the Platform's virtual currency used for promotions and premium features
  • "Monnify" refers to the third-party payment processor integrated into the Platform
  • "AI Features" refers to artificial intelligence-powered tools including search, recommendations, image enhancement, pricing suggestions, content moderation, and voice search

3. Eligibility

To use IbomMarket, you must:

  • Be at least 18 years of age or the age of legal majority in your jurisdiction
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the Service under applicable laws, including sanctions lists
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Not have been previously banned or removed from the Platform

If you are using IbomMarket on behalf of a business, you represent and warrant that you have the authority to bind that business to these Terms.

4. Account Registration & Security

When you create an account, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your information as necessary
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept full responsibility for all activities conducted under your account
  • Not share your account credentials with any third party
  • Not create multiple accounts for deceptive or fraudulent purposes

4.1 Authentication Methods

We offer multiple authentication methods for your convenience and security:

  • Email/password: Traditional login with password requirements
  • Phone-based OTP: SMS one-time password verification
  • Social login: Google One-Tap and other supported providers
  • Passkeys/WebAuthn: Hardware-backed passwordless authentication

4.2 Identity Verification

To enhance trust and comply with regulatory requirements, we may require identity verification including:

  • Phone and email verification for basic account trust
  • National Identification Number (NIN) submission, which is securely hashed and stored
  • Bank Verification Number (BVN) verification through authorised third-party providers
  • Biometric verification through approved identity verification partners
  • Document verification (government-issued ID, passport) as required

Verification is voluntary for basic usage but may be required for certain features, higher transaction limits, or seller privileges. Verified accounts receive a trust badge visible to other Users. We reserve the right to suspend or terminate accounts that fail verification or provide fraudulent documents.

4.3 Account Security Measures

We implement security measures to protect your account, including:

  • Two-factor authentication (2FA) enforcement for administrative and staff accounts
  • Device tracking and known-device management
  • Impossible travel detection to flag suspicious login locations
  • Rate limiting on login attempts with temporary lockout after excessive failures
  • Password breach detection against known compromised credential databases

5. Platform Services

IbomMarket provides the following services and features, subject to availability and feature enablement:

5.1 General Marketplace

Users may list, browse, search, and transact for goods across categories including electronics, vehicles, property, fashion, health and beauty, agriculture, sports, and more. Certain categories (Vehicles, Property, Jobs) are designated as contact-only categories where transactions are arranged directly between parties and no online order or escrow functionality is provided.

5.2 Stores

Sellers may create dedicated storefronts with customisable branding, product collections, coupons and discount codes, loyalty programmes, broadcast messaging to followers, inventory management, analytics dashboards, and multi-branch location support. Store tiers (Basic, Pro, Business) offer progressively more features as described in our Fees & Pricing page.

5.3 Hotel & Accommodation Booking

Hosts may list accommodation properties including hotels, guest houses, short-let apartments, and serviced residences. Guests may search, view availability, and make bookings. Key terms:

  • Bookings are subject to availability and Host confirmation
  • Cancellation policies are set by individual Hosts and displayed at time of booking
  • Verification codes may be issued for pay-at-location bookings
  • Dynamic pricing (weekday/weekend rates) is set by the Host
  • IbomMarket facilitates the booking but is not a party to the accommodation contract between Guest and Host
  • Hosts are responsible for the accuracy of property descriptions, photos, amenities, and pricing
  • Disputes regarding accommodation quality, cleanliness, or misrepresentation should be raised through the Platform's dispute resolution process

5.4 Restaurant & Food Ordering

Restaurant Operators may register their establishments, manage menus, and receive food orders. Buyers may browse restaurants, place orders for delivery, pickup, or dine-in, and track order status in real time. Key terms:

  • Menu items, pricing, availability, and delivery areas are set and maintained by Restaurant Operators
  • Orders are subject to Restaurant Operator confirmation and preparation capacity
  • Estimated delivery times are approximate and may vary due to order volume, distance, or conditions
  • Restaurant Operators are responsible for food safety, hygiene, and compliance with the National Agency for Food and Drug Administration and Control (NAFDAC) regulations
  • IbomMarket does not guarantee food quality or safety; complaints should be directed first to the Restaurant Operator, then through our dispute process if unresolved
  • Group ordering features allow multiple Users to contribute to a single order
  • Pre-orders and scheduled delivery are subject to the Restaurant Operator's operating hours

5.5 Services Marketplace

Service Providers including mechanics, artisans, technicians, and professionals may list their services. Buyers may browse providers, request quotes, and engage services. Service Providers are independent professionals; IbomMarket does not employ, supervise, or guarantee the quality of their work. Service Providers are solely responsible for licensing, insurance, and compliance with applicable professional regulations.

5.6 Urgent Requests

Users may post urgent requests for specific products or services they need immediately. Sellers and Service Providers may respond to these requests. Urgent requests are time-sensitive listings and are subject to the same content and conduct policies as regular listings.

5.7 Custom Orders

The Platform supports custom orders where Buyers provide measurements, specifications, or personalisation details. Sellers and Buyers should agree on all specifications, pricing, timeline, and return terms in writing (through Platform messaging) before production begins. Disputes arising from custom orders will be evaluated based on the documented agreement between parties.

5.8 Digital Products

Sellers may offer digital products including e-books, software, templates, and downloadable content. Digital products are delivered electronically through the Platform. Due to the nature of digital goods, refunds for digital products are at the Seller's discretion unless the product is materially different from what was described or is defective.

5.9 Customer Book (Digital Owe-Book)

The Customer Book feature allows Sellers to record credit and debit relationships with their customers digitally. This is a record-keeping tool only. IbomMarket does not hold, transfer, or guarantee any funds related to Customer Book entries. Disputes arising from Customer Book entries are between the parties involved.

6. Seller Terms

As a Seller on IbomMarket (including Hosts, Restaurant Operators, and Service Providers), you agree to:

  • Only list products, services, or properties you have the legal right to sell or offer
  • Provide accurate descriptions, real photographs, and truthful pricing
  • Fulfil orders, bookings, and service commitments in a timely manner as described
  • Respond to buyer inquiries within a reasonable timeframe (24 hours recommended)
  • Comply with all applicable federal, state, and local laws and regulations
  • Not engage in deceptive, fraudulent, or misleading practices
  • Handle disputes with Buyers in good faith
  • Maintain accurate inventory and promptly mark items as sold or unavailable
  • Comply with the Seller Policy including photo, title, description, and pricing standards

6.1 Prohibited Items & Services

You may NOT list:

  • Illegal drugs, controlled substances, or drug paraphernalia
  • Weapons, firearms, ammunition, or explosives
  • Stolen goods or goods obtained through illegal means
  • Counterfeit, replica, or knockoff products presented as genuine
  • Adult, sexually explicit content or services
  • Content or services promoting human trafficking or exploitation
  • Hazardous materials, chemicals, or radioactive substances
  • Products violating intellectual property rights (patents, trademarks, copyrights)
  • Wildlife, protected species, or products derived from them
  • Human organs, body parts, or bodily fluids
  • Prescription medications without appropriate licensing
  • Gambling services or equipment (except where legally permitted)
  • Hacking tools, malware, spyware, or exploit kits
  • Fake identification documents, diplomas, or certificates
  • Pyramid schemes, Ponzi schemes, or fraudulent investment products
  • Sanctioned goods or goods from embargoed countries
  • Any item or service prohibited by Nigerian law or applicable international law

6.2 Seller Commissions & Payouts

Where the Platform facilitates payment collection (e.g., for orders, bookings, or food delivery), the Platform may deduct a commission or service fee as published in the Fees & Pricing page. Payouts to Sellers are processed to the bank account registered in the Seller's profile. The payout schedule, minimum withdrawal amounts, and commission rates are disclosed in the Seller dashboard and may be updated with reasonable notice.

6.3 Store Verification & Moderation

All listings are subject to review by our moderation team, which uses a combination of automated (AI-powered) and human review. Listings that violate our policies may be removed without notice. Stores may be subject to a verification and approval process. Rejected stores may appeal the decision through the Platform's appeals process.

7. Buyer Terms

As a Buyer on IbomMarket, you agree to:

  • Provide accurate information for transactions, orders, and bookings
  • Complete transactions, orders, and bookings in good faith
  • Exercise due diligence before purchasing, ordering, or booking
  • Inspect goods before payment where feasible (in-person transactions)
  • Report suspicious or fraudulent listings promptly
  • Not engage in fraudulent chargebacks, disputes, or claims
  • Respect Sellers' communication preferences and business hours
  • Honour confirmed bookings and orders, providing timely cancellation when needed
  • Provide honest and fair reviews based on genuine experiences

8. Platform Role & Limitations

IbomMarket is a marketplace platform and technology provider. We provide the technology, infrastructure, and tools for Users to connect, transact, and communicate, but we are NOT a party to transactions between Buyers and Sellers except where explicitly stated.

  • We do not guarantee the quality, safety, legality, or fitness for purpose of listed items, services, or accommodations
  • We do not guarantee the accuracy of listings, user information, or reviews
  • We do not guarantee that transactions, orders, or bookings will be completed
  • We are not responsible for the conduct of Users, including Sellers, Buyers, Hosts, or Restaurant Operators
  • We do not act as an agent, insurer, or guarantor for any party
  • We do not hold funds in escrow for User-to-User transactions unless explicitly offered as a feature
  • We may, but are not obligated to, mediate disputes between Users
  • We do not employ, supervise, or control Service Providers, Hosts, Restaurant Operators, or delivery personnel

9. Payments & Financial Terms

9.1 Payment Processing

Online payments on IbomMarket are processed through Monnify, a licensed payment processor regulated by the Central Bank of Nigeria (CBN). By making a payment through the Platform, you agree to Monnify's terms of service in addition to these Terms. Supported payment methods include debit cards, bank transfers, and USSD. We do not store your raw card data; all payment information is handled by Monnify in compliance with PCI-DSS standards.

9.2 Platform Fees

IbomMarket may charge fees for certain services, including:

  • Premium listing placements and promotional boosts (Bump, Featured, Premium)
  • Store subscriptions (Pro Store, Business Store)
  • Market Coins purchases for virtual currency
  • Commission on facilitated transactions (orders, bookings, food delivery) where applicable
  • Transaction processing fees passed through from payment providers where applicable

All fees are published on the Fees & Pricing page. We reserve the right to modify our fee structure with reasonable notice. Changes to fees will not apply retroactively to existing paid commitments.

9.3 Market Coins

Market Coins are a virtual currency that may be purchased with real money or earned through platform activities (e.g., referrals, engagement milestones). Market Coins may be used for listing promotions, featured placements, and other premium services. Market Coins:

  • Are non-refundable once purchased
  • Have no cash value and cannot be redeemed for cash
  • Are non-transferable between accounts
  • Do not expire while your account remains active
  • Will be forfeited if your account is terminated for policy violations

9.4 Refunds

Refund terms vary by transaction type. For User-to-User transactions, refunds are arranged between parties. For Platform-facilitated payments, refund eligibility depends on the type of service. See our Refund Policy for complete details.

9.5 Seller Wallet & Payouts

Sellers who receive Platform-facilitated payments have access to a Seller Wallet showing their balance, transaction history, and payout management. Payout requests are processed to the Seller's verified Nigerian bank account. Minimum withdrawal amounts and processing times are displayed in the Seller dashboard.

10. Messaging & Communication

IbomMarket provides in-app messaging to facilitate communication between Buyers and Sellers. By using our messaging system, you agree to:

  • Use messaging for legitimate marketplace purposes only
  • Not send spam, unsolicited advertising, or promotional content unrelated to genuine inquiries
  • Not use messaging to harass, threaten, or abuse other Users
  • Not share illegal or harmful content through messages
  • Understand that messages may be reviewed by our moderation team for safety and compliance purposes
  • Accept that message records may be provided to law enforcement when required by law

We may send you notifications via email, SMS, push notifications, or in-app alerts related to your account, transactions, orders, bookings, security, and Platform updates. You may manage your notification preferences in your account settings; however, certain transactional and security notifications cannot be disabled.

11. Artificial Intelligence Features

IbomMarket uses AI-powered features to enhance your experience. By using the Platform, you acknowledge and consent to the use of AI in the following areas:

  • Search & Discovery: AI-powered search including text, voice, and image-based search to help you find products and services
  • Recommendations: Personalised product and service recommendations based on your browsing history, preferences, and behaviour
  • Content Moderation: Automated scanning of listings, images, and messages to detect prohibited content, scams, and policy violations
  • Image Enhancement: AI tools to improve listing photo quality for Sellers
  • Dynamic Pricing Suggestions: AI-generated pricing recommendations based on market data (advisory only; Sellers set final prices)
  • Fraud Detection: Automated analysis of transaction patterns and account behaviour to prevent fraud
  • Sentiment Analysis: Analysis of reviews and feedback to identify issues and improve service quality
  • SEO Optimisation: AI-generated suggestions to improve listing visibility
  • Bot Detection: Automated systems to distinguish genuine Users from bots

AI features are provided as tools to assist Users. AI-generated outputs (recommendations, pricing suggestions, search results) are not guarantees. You retain the right to request human review of any significant decision made solely by automated means, as detailed in our Privacy Policy.

12. Gamification, Rewards & Loyalty

IbomMarket offers gamification features to encourage engagement:

  • Coins & Points: Users may earn coins or points through activities such as listing products, completing transactions, leaving reviews, and daily engagement
  • Badges & Achievements: Recognition for milestones such as verification status, transaction history, and seller performance
  • Leaderboards: Rankings based on engagement, sales, or referrals
  • Store Loyalty Programmes: Individual stores may offer loyalty rewards to their customers

Gamification rewards have no cash value unless explicitly stated. We reserve the right to modify, suspend, or discontinue any gamification feature at any time. Manipulation of gamification systems (e.g., fake transactions, bot activity) is a violation of these Terms and may result in account termination.

13. Affiliate & Marketer Programme

The IbomMarket Affiliate Programme allows approved participants to earn commissions by referring new Users and businesses. Participation is governed by the Affiliate Terms. Key points:

  • Affiliates are independent contractors, not employees of Ibom Market Global Limited
  • Commissions are subject to a hold period, minimum withdrawal thresholds, and legitimate activity verification
  • Spam, self-referrals, fake signups, and misleading promotions are prohibited and will result in termination and forfeiture of unpaid commissions
  • Affiliates are responsible for their own tax obligations

14. Content & Intellectual Property

14.1 Your Content

You retain ownership of content you post on IbomMarket. By posting content, you grant Ibom Market Global Limited a non-exclusive, worldwide, royalty-free, sublicensable licence to use, display, reproduce, modify (e.g., resize images, format text), and distribute your content for the purposes of operating, promoting, and improving the Platform. This licence ends when you delete your content or account, except where the content has been shared with other Users or is reasonably needed for legal compliance.

14.2 Our Content

IbomMarket's name, logo, trademarks, designs, software, AI models, algorithms, and proprietary content are owned by Ibom Market Global Limited and protected by intellectual property laws. You may not use, copy, modify, or distribute our intellectual property without prior written permission.

14.3 User Reviews

Reviews must reflect genuine experiences. Fake, incentivised (unless disclosed), retaliatory, or defamatory reviews are prohibited. We reserve the right to remove reviews that violate these standards. Sellers may not coerce, bribe, or threaten Buyers to alter or remove reviews.

15. Prohibited Conduct

You agree NOT to:

  • Violate any applicable laws, regulations, or third-party rights
  • Infringe on intellectual property rights of others
  • Post false, misleading, deceptive, or defamatory content
  • Harass, threaten, bully, stalk, or abuse other Users
  • Engage in hate speech or discriminatory conduct based on ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
  • Attempt to manipulate reviews, ratings, search results, or leaderboards
  • Use bots, scrapers, crawlers, or other automated tools to access, scrape, or interact with the Platform without authorisation
  • Circumvent, disable, or interfere with security features, rate limits, or access restrictions
  • Attempt to gain unauthorised access to other Users' accounts, our systems, or our data
  • Interfere with the proper functioning or availability of the Platform
  • Create multiple accounts for deceptive or evasive purposes
  • Send spam, unsolicited communications, or phishing messages
  • Use the Platform to launder money or finance terrorism
  • Engage in price manipulation, bait-and-switch tactics, or hidden fee schemes
  • Collect or store other Users' personal data without their explicit consent
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Use the Platform in any way that could harm minors

16. Disputes Between Users

IbomMarket provides a dispute resolution system to help resolve issues between Users:

  • Step 1: Contact the other party directly through Platform messaging to attempt resolution
  • Step 2: If unresolved, file a dispute through the Platform's Dispute Centre with supporting evidence (photos, screenshots, messages)
  • Step 3: Our support team will review the dispute and may mediate between parties
  • Step 4: If the matter involves fraud or criminal activity, we may report to the Nigeria Police Force, the Economic and Financial Crimes Commission (EFCC), or other relevant authorities

The Platform also supports formal return requests for orders placed through the Platform, subject to the Refund Policy. Disputes should be initiated within 7 days of the transaction for best results. Records may be archived after 90 days.

If we are unable to resolve your complaint, you may escalate to the Federal Competition and Consumer Protection Commission (FCCPC) at www.fccpc.gov.ng or contact their complaint portal.

17. Location Services

IbomMarket uses location data to enhance your experience, including:

  • Showing nearby listings, restaurants, and services
  • Calculating delivery distances and fees
  • Providing location-based search results and recommendations
  • Verifying delivery and booking locations
  • Security features such as impossible travel detection

You may enable or disable location services in your device settings. Disabling location services may limit certain Platform features. For details on how location data is collected, used, and protected, see our Privacy Policy.

18. Mobile Application

IbomMarket is available as a Progressive Web App (PWA) and native mobile application. By installing and using the mobile application, you additionally agree to:

  • Grant necessary device permissions (camera, location, notifications, storage) when prompted for relevant features
  • Keep the application updated to the latest version for security and functionality
  • Acknowledge that the application may use local storage, caches, and service workers for offline functionality
  • Comply with the applicable app store's terms of service in addition to these Terms

Camera access is used for listing photo capture, profile pictures, and image-based search. Push notifications are used for order updates, messages, security alerts, and promotional communications. You may manage these permissions in your device and app settings.

19. Suspension & Termination

We may suspend or terminate your account at our discretion, with or without notice, including for:

  • Violation of these Terms or any referenced policy
  • Fraudulent, deceptive, or illegal activity
  • Repeated complaints or reports from other Users
  • Failure to complete identity verification when required
  • Providing false or misleading identity documents
  • Extended inactivity (12+ months without login)
  • Request by law enforcement or regulatory authorities
  • Non-payment of fees owed to the Platform
  • AML/CFT compliance concerns as determined by our compliance team

You may terminate your account at any time by using the account deletion feature in your settings or by contacting us. Upon termination:

  • Your listings, store, and profile will be deactivated
  • Pending orders and bookings must be fulfilled or cancelled before account deletion
  • Outstanding payout balances for legitimately earned commissions will be paid
  • Market Coins and gamification rewards will be forfeited
  • Your data will be handled in accordance with our Privacy Policy data retention section
  • Certain data may be retained as required by law (e.g., AML records for 5 years per NFIU requirements)

20. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and reliability. We do not warrant that:

  • The Platform will be uninterrupted, timely, secure, or error-free
  • Results obtained from the Platform will be accurate or reliable
  • Any goods, services, or accommodations obtained through the Platform will meet your expectations
  • AI-generated recommendations, pricing suggestions, or search results will be accurate or complete
  • Third-party services integrated with the Platform (payment processors, verification providers) will be continuously available

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IBOM MARKET GLOBAL LIMITED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM:

  • Your use of or inability to use the Platform
  • Any transaction, order, booking, or interaction between Users
  • Unauthorised access to or alteration of your data
  • Conduct of any third party on the Platform
  • Reliance on AI-generated outputs or recommendations
  • Service interruptions, technical failures, or data loss
  • Actions of payment processors, identity verification providers, or other third-party services

Where liability cannot be excluded by law, our total aggregate liability shall not exceed the greater of (a) the amount you have paid to IbomMarket in the 12 months preceding the claim, or (b) the sum of Ten Thousand Naira (₦10,000).

22. Indemnification

You agree to indemnify, defend, and hold harmless Ibom Market Global Limited, its affiliates, officers, directors, employees, agents, and partners from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Platform; (b) your violation of these Terms or any applicable law; (c) your Content or listings; (d) your transactions with other Users; (e) your infringement of any third-party rights; or (f) any negligent or wilful misconduct.

23. Anti-Money Laundering & Counter-Terrorism Financing

In compliance with the Money Laundering (Prevention and Prohibition) Act 2022 and regulations of the Nigeria Financial Intelligence Unit (NFIU), Central Bank of Nigeria (CBN), and the Special Control Unit against Money Laundering (SCUML):

  • We may require enhanced identity verification for certain transactions or account activity thresholds
  • We monitor transactions for suspicious patterns and may file Suspicious Activity Reports (SARs) or Currency Transaction Reports (CTRs) with relevant authorities
  • We screen Users against international sanctions lists, Politically Exposed Persons (PEP) databases, and watchlists
  • We may freeze, restrict, or close accounts pending investigation of suspicious activity
  • We are legally required to retain AML-related records for a minimum of 5 years
  • We may share information with law enforcement and regulatory authorities as required by law without prior notice to the affected User

24. Governing Law & Jurisdiction

These Terms and any disputes arising from your use of IbomMarket shall be:

  • Governed by and construed in accordance with the laws of the Federal Republic of Nigeria, including the Federal Competition and Consumer Protection Act 2018 and the Nigeria Data Protection Act 2023
  • First attempted to be resolved through informal negotiation within 30 days
  • If unresolved, submitted to mediation administered by a mutually agreed mediator in Uyo, Akwa Ibom State
  • If mediation fails, subject to the exclusive jurisdiction of the courts of Akwa Ibom State, Nigeria, or the Federal High Court of Nigeria as applicable

Nothing in this clause limits the right of either party to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.

24a. Dispute Resolution & Arbitration

Any dispute arising from or relating to these Terms shall first be resolved through good-faith negotiation between the parties. If unresolved within 30 days, either party may submit the dispute to mediation administered by a qualified mediator in Uyo, Akwa Ibom State. If mediation fails within 60 days, the dispute shall be submitted to binding arbitration under the Arbitration and Mediation Act 2023 (Nigeria). The arbitration shall take place in Uyo, Akwa Ibom State, and the decision shall be final and binding.

Notwithstanding the foregoing, either party may seek injunctive relief in the courts of competent jurisdiction in Nigeria.

You may also file a complaint with the Federal Competition and Consumer Protection Commission (FCCPC) at fccpc.gov.ng.

25. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

26. Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, Community Guidelines, Seller Policy, Buyer Protection, Refund Policy, Affiliate Terms, and Fees & Pricing page, constitute the entire agreement between you and Ibom Market Global Limited regarding your use of the Platform. These Terms supersede all prior agreements, understandings, and representations, whether written or oral.

27. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Post the updated Terms on the Platform with a new "Last Updated" date
  • Notify you via email, in-app notification, or both
  • Provide at least 14 days' notice before material changes take effect

Your continued use of IbomMarket after the effective date of updated Terms constitutes acceptance of the changes. If you do not agree with the updated Terms, you must stop using the Platform and may request account deletion.
